Unless otherwise agreed in writing, payment is due in full upon order confirmation.
b) Payment methods
We accept bank cards (mada, Visa, Mastercard, Apple Pay) through a licensed payment gateway, and bank transfer for corporate orders.
Athar does not see or store your bank card details, as they are processed directly by a payment gateway licensed by the Saudi Central Bank.
c) When an order becomes binding
- The Client confirms the order form
- The Client approves the design file it supplied
- Athar receives complete and accurate employee data
- The due payment is actually received into Athar's account
Where payment is delayed, Athar may suspend execution of the order until payment is received, with the delivery date extended by a period equal to the delay.
7. Design and Employee Data
a) Client responsibilities
The Client bears full responsibility for:
- Supplying Athar with a print-ready design file conforming to the technical specifications in paragraph (c)
- The accuracy and completeness of the employee data provided — names, job titles and employee numbers
- The correctness of the images supplied and the matching of each image to the intended employee
- Holding the necessary rights to the logos, images, fonts and content it supplies to us
- Obtaining the lawful bases and approvals required to process its employees' data and share it with Athar
- The final printed result as regards design, colours, fonts and arrangement of elements
- Reviewing and approving the file before production begins
b) The limits of Athar's role
Athar's role is confined to printing, encoding and delivery. Specifically:
| ✗ Athar does NOT do any of the following |
|---|
|
✗ Design or redesign the card ✗ Edit colours or convert colour modes ✗ Change fonts or convert them to outlines ✗ Adjust sizing or bleed margins ✗ Enhance or crop images ✗ Rearrange design elements ✗ Correct any error in the supplied file |
| ✓ Athar does ONLY the following |
|---|
|
✓ Print the file exactly as supplied, unmodified ✓ Merge employee data and photographs automatically into the positions the Client defined in its template ✓ Impose the cards on the print sheet ✓ Encode the chip and activate the digital profile ✓ Cut, finish, pack and ship |
c) Required technical specifications
The supplied file must conform to the following:
| Final size | 85.6 × 54 mm (CR80) |
| Bleed | 1.5 mm additional on each side — i.e. 88.6 × 57 mm with bleed |
| Safe area | 3 mm inside the trim line — no text or important element outside it |
| Resolution | 300 dpi minimum |
| Colour mode | CMYK — RGB files are not accepted |
| Fonts | Converted to outlines — live fonts are not accepted |
| Images | Embedded in the file, not linked |
| Format | Print-ready PDF · or AI with all elements fully embedded |
| Both sides | A separate file or page for each side, with the side identified |
d) Formal check and rejection
Athar carries out a formal check of the file to verify conformity with the specifications above. This check does not constitute a review of the design, nor any confirmation of its suitability.
e) Final approval
f) File replacement and change requests
| Timing of request | Treatment |
|---|---|
| Before approval | The Client supplies a conforming replacement file · the lead time runs from its receipt |
| After approval, before production | Change request that may incur fees and delay |
| After production begins | Treated as a new order at full cost |
g) Disclaimer as to the design outcome
Athar bears no responsibility for the printed result where it conforms to the file supplied by the Client, including — without limitation — spelling errors, colour variance arising from the file's settings, text cut off outside the safe area, poor clarity of low-resolution images, and unsuccessful design choices.
8. Delivery
| Production time | 3 – 4 business days for standard cards, commencing once the binding-order conditions in clause 6-c are complete |
| Dual-chip cards | Longer lead time, specified in the order form according to the Client's system |
| Delivery area | Within the Kingdom of Saudi Arabia only |
| Risk transfer | Risk of loss and damage passes to the Client upon receipt of the shipment |
| Title | Title to the cards remains with Athar until payment is received in full |
Athar is not responsible for delays caused by the shipping company or by incorrect address details supplied by the Client.
9. Inspection on Receipt
The Client must inspect the shipment within 7 business days of receipt and notify Athar in writing of any shortage in quantity or visible defect.
Once this period expires without notice, the shipment is deemed accepted as to quantity and visible defects, while the warranty provisions continue to apply to latent manufacturing defects.
10. Warranty
a) Scope
Athar warrants that the product is free from manufacturing defects for one year from the date of delivery. The warranty covers:
- Printing — peeling, abnormal fading, cutting defects, material deviation from the approved design
- The chip — failure of the chip caused by a manufacturing defect
The obligation is limited to replacing the defective product with an equivalent product.
b) Exclusions
- Bending or breaking the card — including keeping it in a back pocket
- Punching a hole in the card to attach a lanyard or clip
- Exposure to high heat or a strong magnetic field
- Exposure to water, liquids or chemicals
- Scratches and wear arising from normal use
- Attempts to reprogram or tamper with the chip by any party other than Athar
- Use outside the product's intended purpose
Note: we recommend using a suitable card holder and never punching the card, in order to preserve the integrity of the chip.
c) Claim process
- Notify Athar by email with clear photographs and the card number
- Athar responds within 5 business days, accepting or rejecting the claim with reasons
- If accepted: the defective card is returned to Athar at Athar's expense
- A replacement is issued within 10 business days of receipt of the defective card
If inspection shows the failure resulted from misuse, the Client bears the shipping cost and the card is treated as a replacement card.
11. Replacement Cards
Where a card is lost or damaged for a reason not covered by the warranty, a replacement card is issued for a fee equal to half the actual purchase price of the card, inclusive of design, printing, encoding and activation.
"Actual purchase price" means the price the Client in fact paid for the original card, not the listed price.
12. Cancellation and Returns
a) Cancellation
| Timing of cancellation | Availability | Refund |
|---|---|---|
| Before design approval | Available | Full refund less administrative fees and costs actually incurred |
| After approval, before production | Available | Refund less preparation and material costs |
| After production begins | Not available | No refund |
b) Returns
The Client may request a return within 7 business days of receipt in the following cases only:
- Receipt of a defective product resulting from a manufacturing fault
- Material deviation from the approved design
- Shortage in the quantity delivered
Remedy: replacement is the primary remedy. Where replacement is not possible, the amount is refunded.
c) Return shipping
| Where a defect is confirmed | Athar bears the cost of return and replacement shipping |
| Where the product is sound and conforming | The Client bears the shipping cost |
d) Refunds
Amounts due are refunded within 14 business days of approval of the request, using the original payment method. Banks may require additional time for the amount to appear in the Client's account.
13. Platform and Digital Service
a) Service term included
This means the Client pays for the card once only, and in return receives:
- Operation of the employee's digital profile and its continued function when the card is tapped
- Full, unrestricted access to the management platform
- Unlimited editing, addition and deactivation of employee records
- Technical support
Athar imposes no annual, monthly or renewal subscription fees for these services.
b) Use of the platform
- The Client is responsible for the confidentiality of its account credentials and for all activity conducted through its account
- The Client undertakes to notify Athar immediately of any suspected unauthorised use
- Using the platform for any unlawful purpose, or attempting to breach or reverse-engineer it, is prohibited
- Athar reserves the right to suspend any account that is misused
c) Maintenance and updates
Athar may carry out periodic maintenance and updates to the platform. The Client is given at least 48 hours' prior notice of planned maintenance, which is performed outside working hours where possible. Urgent security updates may be applied immediately.
d) Technical support
| Channels | Email · WhatsApp · support tickets within the platform |
| Working hours | Sunday – Thursday · 9 AM – 5 PM Saudi time |
| First response time | One business day |
Support does not extend to problems with the Client's own systems, devices or network.
14. Access Control and Attendance
These features operate only with compatible systems and readers specified in the order form. The Client undertakes to provide Athar with its system specifications before ordering.
Athar's role is limited to supplying cards to the agreed specification. Integration with, and configuration of, the Client's system is the responsibility of the Client or its system provider, unless otherwise agreed in writing.
Card deactivation — an important distinction
| Type of deactivation | Performed by | Effect |
|---|---|---|
| Digital profile deactivation | The Client, from the Athar platform | Immediate — the employee's page stops working |
| Access credential deactivation | The Client, in its own access system | According to that system — outside Athar's scope |
15. Intellectual Property
| Owned by Athar | The platform, software, APIs and technical architecture · Athar's trademark and visual identity · Athar's design templates · website content |
| Owned by the Client | Its logo and trade name · its employee data · designs it supplied itself |
Since the design is supplied in full by the Client (clause 7), ownership of the design and its content remains with the Client, and Athar claims no right in it. Athar's ownership is confined to its own templates, elements and visual identity as used in the "Athar Original" product.
Copying or reusing any content of the website or platform without Athar's written permission is prohibited.
16. Use of Client Name in Marketing
Athar will not use the Client's name or logo in its marketing materials without the Client's prior written consent.
The Client may grant or withdraw that consent at any time by written notice.
17. Data Protection
Athar undertakes to process personal data in accordance with the Personal Data Protection Law and its Implementing Regulations, and as set out in the Privacy Policy published on the website.
For the purposes of Client employee data, Athar acts as Processor and the Client acts as Controller; the relationship is governed by a separate Data Processing Agreement on request.
The Client confirms that it has obtained the lawful bases and approvals necessary to share its employees' data with Athar.
18. Confidentiality
Each party undertakes to keep confidential the information it receives from the other — pricing, technical data, business plans and employee data — and not to disclose it to any third party except to perform the service or pursuant to a legal obligation.
This obligation continues for three years after the end of the contractual relationship.
19. Subcontractors
Athar may engage contracted parties to deliver the service — such as printers, shipping companies and hosting providers — and Athar remains responsible to the Client for their performance, binding them to data protection obligations no less than those set out in these Terms.
20. Liability
Athar exercises due care in providing its products and services. Nevertheless:
- Athar's liability for any claim is limited to the value of the order to which the claim relates
- Athar is not liable for indirect or consequential damages or loss of profit
- Athar is not liable for damages arising from inaccurate data supplied by the Client
- Athar is not liable for the function of cards with systems whose compatibility was not documented in advance
Nothing in the foregoing shall be construed as contrary to the mandatory provisions of Saudi law.
21. Force Majeure
Neither party is deemed in breach of its obligations where performance is prevented by circumstances beyond its reasonable control — such as natural disasters, governmental decisions, widespread interruption of communications or electricity, or disruption to supply and shipping chains.
The affected party shall notify the other immediately, and the timelines extend by a period equal to the disruption. Where the circumstance continues for more than 90 days, either party may terminate the order and settle outstanding amounts.
22. Termination
Athar may suspend the service or terminate the relationship in the following cases:
- Non-payment after notice and a period of not less than 15 days
- A material breach of these Terms not remedied within 30 days of notice
- Unlawful use of the platform or the products
- Provision of materially inaccurate data
The following survive termination: confidentiality · intellectual property · data protection · liability · settlement of outstanding amounts.
23. Amendment of These Terms
These Terms may be updated from time to time. The version published on the website at the time an order is placed applies to that order. Where a material amendment is made, existing clients will be notified before it takes effect.
24. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Kingdom of Saudi Arabia.
Where a dispute arises, the parties shall seek an amicable settlement within 30 days. Failing that, the dispute shall be referred to the competent judicial authority in the Kingdom.
25. General Provisions
- Severability: if any provision is held invalid, the remaining provisions continue in force.
- Assignment: the Client may not assign its rights or obligations without Athar's written consent.
- No waiver: Athar's failure to exercise any right does not constitute a waiver of it.
- Notices: deemed valid if sent to the registered email address or through the platform.
- Entire agreement: these Terms, together with the order form and the Privacy Policy, constitute the entire agreement between the parties.
26. Governing Language
These Terms are available in Arabic and English. In case of any discrepancy in interpretation, the Arabic version prevails.
